All sales will be limited to the terms and conditions contained herein. An objection by Buyer to any of the terms contained herein shall be deemed to have been waived if we do not receive the objection in writing within 14 days of receipt of goods or acknowledgement or before part of the merchandise or services is accepted by Buyer, whichever may occur first.
By submitting a Purchase to Eclipse Scarves Ltd t/a Eclipse Branding, customer agrees that the transaction will be bound by the terms and conditions listed within this Website and cannot be superseded by any terms, conditions or provisions contained in customer’s purchase order and/or vendor’s agreement.
INTENDED USE OF PRODUCTS:
The products offered within this Website, catalogues or any marketing materials are intended for the general use of consumers of all ages and are not primarily intended for children 12 years of age or younger.
STATEMENT OF LIMITED LIABILITY:
Eclipse Scarves Ltd t/a Eclipse Branding makes no warranties whether expressed or implied including, but not limited to, any implied warranties of merchantability and fitness for a particular purpose or non-infringement. In no event shall Eclipse Scarves Ltd t/a Eclipse Flag Suppliers be liable for any incidental, indirect, special, punitive or consequential damages of any kind including, but not limited to, lost revenue or profits regardless of the form of action whether in contract, tort (including negligence) or otherwise, even if Seller has been advised of the possibility of such damages. In no event shall the maximum liability of the Seller exceed the product price collected by Seller. Terms inconsistent with those stated herein which may appear on Customer’s formal order will not be binding to Eclipse Scarves Ltd t/a Eclipse Branding
GUARANTEE:
Eclipse Scarves Ltd t/a Eclipse Branding have been serving this industry for over 20 years with reliable, high- quality products and we are dedicated to customer satisfaction. All merchandise manufactured by Eclipse Branding ltd is inspected before shipment and is unconditionally guaranteed to be free from defects of material and workmanship for a period of seven (7) days.
Seller’s obligations of merchandise deemed as defective and which are returned to factory freight prepaid within (7) days of the date of shipping, is limited to a refund, repair or replacement of merchandise at Seller’s discretion, without any further obligation or liability on the part of the Seller. Additionally, Seller makes no warranty expressed or implied against damage of vehicle surfaces or loss of product, as Factory has no control over how products are cared for, altered, stored, installed and/or used, or the surface for which the products are applied. Failure to provide Eclipse branding Ltd notice of any claim within thirty (7) days from the date of shipping and failure to return such products within thirty (7) days or if any changes or alterations made to product shall constitute a waiver of all such claims in respect to such products.
RETURNS:
Eclipse Scarves Ltd stands behind our products 100% and will make good on any products proven defective in materials and workmanship. Eclipse scarves Ltd must be notified of all damaged orders or discrepancies within 7 days of order receipt. For a quicker response, detailed photographs showing different angles are recommended along with an explanation of what photographs are showing. Any changes or alterations of any kind to the products or hardware will void any warranties.
All returns must be authorised in advance by the Eclipse Branding Ltd within 7 days of receipt of goods. Buyer must pre pay all freight costs on authorised returned goods. Any returns not authorised by us will be refused and returned to sender at buyer’s expense. No returns will be accepted for custom imprinted, special orders, non-stock and some unprinted merchandise unless it is determined by the factory to be defective.
GOVERNING LAW:
By placing a purchase order with Eclipse Scarves Ltd t/a Eclipse Brandingthe buyer agrees that all transactions shall be governed and construed according to the laws of the United Kingdom.
SALES OF GOODS
By placing a purchase order with Eclipse Scarves Ltd t/a Eclipse Brandingthe buyer agrees that all transactions shall be paid for before dispatch, No goods will be dispatched without 100% payment although this will not hold production of the goods.
